Police said 4-year-old Vivian Savella was killed hours after a judge placed her in her father’s primary care.
HOUSTON — A 4-year-old girl was fatally shot in a west Houston home after a family court ruling placed her in her father’s primary care, and her mother later died from a self-inflicted gunshot wound, according to police and local news reports.
Authorities identified the child as Vivian Savella. Houston police said officers responding to the home found the girl dead and her 35-year-old mother wounded. The mother was taken to a hospital in critical condition and was pronounced dead the following day. Police have described the case as an apparent murder-suicide and said the mother was believed to have shot Vivian before shooting herself.
The shooting happened Tuesday evening at a home on Terra Reserve Place in west Houston, according to KPRC. Police said a custody hearing involving Vivian and her mother had taken place earlier that day. Vivian’s family later confirmed through an attorney that a judge had placed the child in her father’s primary care and that she was expected to go to him that evening.
Court documents reviewed by ABC13 showed Vivian’s father had been awarded primary custody. The documents said the mother’s time with Vivian was to occur only under continuous supervision. The father’s attorney told the station that the court did not specify exactly how the custody exchange was to take place.
The attorney also said the supervision was expected to be handled through a court-appointed agency. Because the ruling had just been issued, however, the agency had not yet been notified of the case, according to the attorney. Authorities have not publicly said whether anyone else was responsible for supervising Vivian at the time of the shooting.
Police said other people were inside the home when the gunfire occurred. Investigators have interviewed witnesses as they work to establish the sequence of events. Officials have not released a detailed account explaining what happened immediately before the shooting or identified a confirmed motive beyond noting the custody hearing earlier in the day.
Vivian’s family released a statement through her father’s attorney saying the family was devastated by her death. The statement said Vivian was deeply loved by her father, Aaron, and others who knew her. It also said Aaron had followed the court process and expected Vivian to come into his primary care that evening.
Authorities initially said the mother was expected to survive after being hospitalized in critical condition. Houston police later confirmed that she died at the hospital the next day. Local reports identified her through court and family records, but police reports reviewed by news organizations initially referred to her only as the child’s 35-year-old mother.
The case drew renewed attention after the custody ruling became public, but the exact reasons behind the court’s restrictions on the mother have not been fully detailed in the verified reports reviewed.
